All that this says is that if you are a scalper you have to pay for a license. If a person sells tickets for more than the original price AND (emphasis added) that person is commonly known as a ticket scalper, then he has to pay a license. Read the law again. Admittedly, I don't know anything about case law on this issue. But the code you have cited does not appear to make selling tickets for more than face value illegal. It also does not appear to require a license to do so, unless a person is commonly known as a ticket scalper. In other words, a casual fan could sell tickets for any price he wanted without violating the law you have cited.
Regardless, it is hardly TI's responsibility to enforce such a law. And even if it were, how could you tell whether or not somebody had a license?
Note too that ebay is doing EXACTLY what TI ticket exchange has done in the past - allowing Alabama tickets to be sold by one individual to another, without the direct participation of the forum owner (ebay or TI, as the case may be). Except in ebay's case, they charge a fee. TI, if you're really concerned about liability here, you might have your lawyer look into ebay. If it's legal for them, it's legal for TI.
